Employment legislation changes to look for in 2019

It’s that time of year again! Hopefully all of your Christmas preparations are complete or at the very least well under way!

So, with the New Year only weeks away it’s worth knowing what to look out for, employment legislation wise, in the year ahead!

 

Statutory Increases

Please note SMP, SAP and ShPP are paid at the above rates or 90% of the employee’s weekly earnings if that figure falls below the statutory rate.

Other changes to look out for in 2019:

Executive Pay Reporting

From 1 January 2019 companies that employ 250 staff or more will have to report on the ratio between the Chief Executive Officer and employee’s pay and benefits.  The first reports have to be in by 1 January 2020 and so companies need to begin gathering evidence in good time.

Itemised Pay Statements

Workers will be entitled to itemised pay statements, in the same way that employees receive them, from 6 April 2019. The payslip must show the total hours worked where the pay varies (i.e zero hours or variable hour contracts) according to the hours worked.

Parental Bereavement Leave and Pay

Looking a little further ahead the new rules relating to bereavement leave and pay for parents are expected to come into force in April 2020.  As it currently stands parents are expected to be entitled to two weeks paid leave; taken either consecutively or as a single week taken at different times.   A lot of businesses already offer discretionary payments for bereavement leave but if you do not already have a policy on pay for bereavement it would certainly worth putting one in place.  Please call the advice line if you would like further guidance.

Brexit

Last but by no means least the UK’s date for leaving the EU falls on 29 March 2019 (see here for more information).  This date can be extended by agreement so who knows!

New Legislation

There is new legislation in the pipeline that will affect zero hours and agency workers which we will report on accordingly.
