HSE Fee for Intervention

April saw the second increase in the fee since the scheme started. Here we take a look in more detail at it.

The HSE’s Fee For Intervention (FFI) scheme was launched in 2012, with the objective of placing the burden of the HSE’s costs on any business in which the HSE have had to intervene due to a material breach in health and safety legislation, and thus reducing the cost to the taxpayer for such action.

The fee covers things like the investigation time spent by inspectors, and any support given to the business in rectifying the issues, and visits / other contact from the HSE when dealing with a material breach.

Material Breach

A finding by the inspector which is deemed serious enough for a notice of contravention (NoC) to be issued to the business, once this happens the fee is charged at an hourly rate and will include any time the inspector spends dealing with your case so any time obtaining specialist advice, preparing reports, conducting follow up visits etc.

That depends on the amount of time the HSE spend dealing with the matter – the fee is charged hourly at £154, this has increased from the previous rate of £129 as the HSE reported a deficit this year, which led to the need for the increase.

How can you avoid this? The simple answer is, be compliant with the law and don’t commit a material breach – and no fee will be payable. It's also important to note that where there is no material breach and the HSE just offer advice, they will also not charge a fee for this.
