Increase in Employment Tribunal Fees

In July, the Supreme Court ruled that employment tribunal fees were unlawful. Following this decision, the number of claims has already increased threefold.  The July ruling found that the fees – which were set up to £1,200 - were “discriminatory” against women, after a review found that the number of employment tribunals has fallen by 70% following the fee introduction.

We have seen a large increase in claims this year in the period July to September (following the ruling in July) by 120% to 30,339 compared with 13,759 during the previous quarter, The breakdown of claims made to the Tribunal Service during the year to September 2017 has included:10,035 claims brought for unauthorised wage deductions, 10,192 for unfair dismissal, and 17,166 for equal pay.

The increase in the number of claims made has also seen a marked increase in the number of equal pay cases - almost half of equal pay claims for the year to date (7,563) were brought between July and September 2017.
