Do part-time employees get bank holidays if they don’t work on a day that a bank holiday falls?

24 August 2023

Part-time employees should not be treated less favourably in comparison to full-time employees in relation to their terms and conditions of employment. This will include their rights in relation to bank holidays.

Where full-time employees are entitled to paid bank holidays, unfair treatment will occur to part-time employees who are not provided the same rights. This will apply to all part-time employees who do not work on a Monday or Friday - which are the normal days on which a bank holiday falls. These part-time employees should be allocated bank holidays on a pro-rated basis. This will ensure that they are treated fairly in comparison to full-time employees.

Employers should look at their company contracts and handbooks. If this matter has not been addressed, they should take steps to ensure they adopt a policy on dealing with part-time workers and bank holidays.

Quest can help employers to update employment contracts and handbooks.
